Types of matters that will not be assisted
VLA will not normally make a grant of legal assistance in any of the following:
- criminal law matters:
- court applications for stays (see Criminal law guideline 8)
- court applications for funding orders (see Criminal law guideline 8).
- State family matters: applications to revoke or vary orders if there are no proceedings.
- Commonwealth family law matters:
- change of name applications
- enforcement proceedings in a family law matters
- contempt of court or breach of court orders
- preparation and filing of consent orders only.
- State civil law matters: (see State civil law guideline 8)
- cases in the Residential Tenancies List at the Victorian Civil and Administrative Tribunal
- town planning disputes
- Royal Commissions or Parliamentary inquiries
- internal disputes in organisations
- proceedings on behalf of an unincorporated association or a corporation
- employment disputes
- building disputes
- change of name applications
- commercial disputes or business disputes
- testator family maintenance applications
- an application by a corporation or any other party for an adoption order or opposing an adoption order
- a plaintiff if there is an alternative funding arrangement available.
- Commonwealth civil law matters:
- assistance only to argue an error of law in a migration case
- proceedings under the Proceeds of Crime Act 1987 (Cth) (see Commonwealth civil law guideline 7).
