Guideline 9 – hearings under the Crimes (Mental Impairment and Unfitness to be Tried) Act

VLA may make a grant of legal assistance to a person for a hearing under the Crimes (Mental Impairment and Unfitness to be Tried) Act 1997 if the matter meets the State reasonableness test.

Documentary requirements

Applications under this guideline are only made by the standard grants assessment process.

A member of the either the section 29A practitioner panel or section 30 referral panel or any other person seeking a grant of legal assistance should forward a completed VLA application form and copies of any relevant documents for assessment.

VLA does not apply the means test to an application for a grant of legal assistance in a hearing under the Crimes (Mental Impairment and Unfitness to be Tried) Act.
