Table MM – Lump sum and other fees for criminal appeals in the High Court prior to 18 January 2011

Table MM sets out the fees payable by VLA for criminal appeals in the High Court.

These fees are claimed using the High Court special leave and appeal – Table MM tax invoice.

Service/proceeding Fee payable: special leave Fee payable: appeal
The lump sum preparation fee covers the work involved in:
  • preparing any necessary documentation
  • perusing documents
  • counsel’s appearance on the first day of the hearing.
The lump sum fee does not cover:
  • work by the lawyer in instructing counsel
  • conferences with counsel.
But VLA may also pay for the additional work detailed in the rows below (as well as for the additional work listed above).

Note: VLA will pay this fee only if the submissions are extraordinarily lengthy or complex. Specific approval required.

However, if VLA has previously made a grant of assistance for an application for special leave, then the assisted person must seek specific approval for a grant to appeal to the High Court.
