Table G2 – Lump sum fees for sentence appeals in the County Court
Table G2 sets out the fees payable by VLA for a County Court appeal against sentence by either the convicted person or the Director of Public Prosecutions.
These fees are effective from 18 January 2011 to 30 June 2011. The new fees apply to all existing grants of aid where the matter has not been finalised, and new grants of aid made on or after that date. Where an appearance was conducted prior to 18 January 2011, the appearance fees in Table D1 in fee Schedule 7 are payable.
The fee set out in this table covers all necessary work, including preparation and appearances. VLA will not pay additional fees for:
The hourly rate is based on $149 per hour. This is 80 per cent of the midpoint between solicitor and counsel rates in County Court Civil Scale B (contained in County Court Civil Procedure Rules 2008 – Appendix A). This represents an allowance of 50 per cent for preparation and 50 per cent for appearances.
These fees are claimed using the sentence appeals in the Appeals – tables G, H, K, K(i), K(ii) and L tax invoice.

Except where counsel or solicitor advocate practices in the circuit town or a surrounding township, circuit fees in accordance with Table NN are payable.
Where counsel is briefed in a County Court appeal against sentence, the brief fee in Table G2 is the fee which must be paid to counsel.
