Table D1 – Lump sum and other fees for bail applications, appeals and proceedings for breach of certain County Court orders prior to 18 January 2011

Table D1 sets out the fees payable by VLA in bail applications, appeals, and proceedings for breach of order for suspended sentence, community-based order, probation or intensive correction order in the County Court.

These fees are claimed using the Criminal proceedings – miscellaneous – tables CC, D1 and FF tax invoice.

The lump sum preparation fee covers the work involved in:
  • obtaining instructions
  • preparing the case
  • proofing witnesses.

Circuit fees

If a lawyer advocate does not practice in the circuit town, then VLA will also pay circuit fees, as set out in Table EE – Circuit and overnight fees payable by VLA for work done in accordance with Table D1 and/or Table D3.

VLA may limit assistance in County Court appeals

In County Court appeals, VLA may limit the number of days for which it may make a grant of legal assistance.
